ORDER CHANGES AND CANCELLATIONS

Once your order is placed, you cannot change, alter, or cancel your order in any way. In the event an item in your order is NOT AVAILABLE you will be offered alternatives or the option to receive a full refund for the item.

REFUNDS

All refunds must fill out a return authorization request form within 3 days of receiving your gown and returned within 3 days.

All refunds will be charged a 15% restocking fee for the price of the item FOR ONLINE PURCHASES ONLY.

 Restocking fees are deducted from your final refund amount.

The refund will only be issued once we receive the dress and inspect it to ensure it is in its original state.

Items must be unworn, unwashed, and with tags attached in order to be accepted as a return.

All Products marked Final Sale or priced at $698 or above are all “Final Sale,” and are not returnable for a refund or exchange. NO EXCEPTIONS.

If you request a return label while filling out your Return Authorization Form an $15.00 fee will be deducted from your refund amount

EXCHANGES

You may request an exchange ONE TIME without penalty by filling out the Return Authorization Form on purchases not marked “Final Sale” within 3 days of receiving your original online purchase only. You must send the item you wish to exchange back in its original condition, unworn, unwashed and with all tags attached. The new order will be placed upon receipt and inspection of your original item. At that time we will either refund or charge the difference (depending on the price of the new dress) to your account. Any original shipping method payments will not be refunded, and the return label for the exchange is at the expense of the customer. If you need an exchange that is time sensitive due to an upcoming wear date, please let us know ASAP via telephone or email and we can offer you alternate options.

RETURN INSTRUCTIONS FOR ONLINE PURCHASES ONLY

ALL Returns for Refunds or Exchanges must fill out the following form:

This must be done within 3 days after receiving your order.

There is a 15% restocking fee on the price of the item for all returns for refunds FOR ONLINE PURCHASES ONLY.

You may request a return label for $15.00, which will be deducted from your refund amount

Orders may be exchanged one time for another item.

All Products priced at $698.00 or above are considered a Final Sale, and are not returnable for a refund or exchange.

Place your item back in the bag or box with your original packing slip. Clearly write your return authorization number on the outside of the return package. Boxes marked incorrectly may not be accepted by our receiving department.

Your return must be postmarked within 3 days of requesting your return authorization number.

Items must be unworn, unwashed, and with tags attached in order to be considered for a return. Once your item is received and inspected, we will send you an e-mail notification that your refund has been processed. PLEASE NOTE: Once we receive your package, it can take 5-10 business days to process your refund.

If your return does not meet all these requirements, your return will not be accepted.

If you need an exchange that is time sensitive due to an upcoming event, please let us know ASAP and we can offer you alternate options.

UPS RETURN LABEL

If you request a UPS return shipping label, an $15.00 fee will be deducted from the refund amount or charged to the credit card used to make the purchase.

ORDER DELAY

For Orders placed by Overnight Method, please keep in mind that “Overnight” will be by the next business day. If it is an “In Stock” Overnight Order, please be aware that some dresses must first come from the manufacturer to our physical location and then to you. This could, of course, add shipping time.

Due to unforeseen circumstances, such as inclement weather, there are rare occasions that shipments may be delayed. These extreme cases are rare and cannot be controlled by Terry Costa. Terry Costa will not be liable for delays in such situations. Rest assured that, even in extreme circumstances we will use all tools at our disposal to ensure you receive your item as quickly as possible.

The Terry Costa Team takes our customers’ privacy and security very seriously, both in-store and online. As such, we have implemented fraud filters in an effort to protect our online customers from any suspicious or fraudulent charges to their card. If your order triggers a review by our fraud prevention department, we may require additional information in order to approve your card for processing. You will be contacted immediately in regards to this matter, and we ask that you contact us back as soon as possible to confirm your order and avoid any further delay. Any order held for verification purposes by our fraud prevention department may be delayed until needed information is received and the confirmation process is completed. Orders may be flagged due to incorrect/incomplete billing or shipping information, address confirmation, or return policy review. Any delay in shipping or needed upgrade due to this verification process is the responsibility of the customer.

PRODUCT AVAILABILITY 

Terry Costa has made every effort to display accurately the products featured on the Site. However, the colors we use and the capabilities of your computer monitor will affect the colors you see on your screen. Terry Costa cannot guarantee that your computer monitor will accurately display color, texture, or any merchandise details.

Terry Costa is not responsible for errors made in selecting a dress size and cannot guarantee a dress will fit. It is the sole responsibility of the shopper to use a tape measure to take their measurements properly and then select the size that best fits them based on the size chart for the particular item purchased. Terry Costa reserves the right to change sizes available and the size charts at any time.

SITE CHANGES

In order to keep the site current with our latest fashion ideas, Terry Costa frequently changes the merchandise offered. This means that we cannot guarantee that an item displayed on a previous visit to the Site will still be available when you visit again. We reserve the right to make changes to the Site without prior notice. Should you be unable to locate an item you saw on a previous visit, please contact us and we will make every effort to meet your needs. Prices displayed on the Site are quoted in U.S. dollars and are valid and effective only in the United States.

Risk of Loss: Risk of loss or transfer of title to the Buyer or customer occurs when Terry Costa delivers the merchandise ordered to a common carrier in good condition for shipment to the customer.

User Comments, Feedback, Postcards, and other submissions: We welcome your comments and feedback regarding the Site, our products and our services. All comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to Terry Costa on or by the Site or otherwise disclosed, submitted or offered in connection with your use of the Site (collectively, the "Comments") shall be and remain Terry Costa’s property.

Such disclosure, submission or offer of any Comments shall constitute an assignment to Terry Costa of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments without payment of any compensation.

Who Can Enter

1. To be eligible to participate in this contest, entrants must be legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older, and located in the U.S. at the time of entry.

2. Employees of Terry Costa, Inc., their affiliated companies, advertising and promotion agencies, and the immediate family members of each are ineligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren.

How to Enter

1. No purchase is necessary to enter. Only one entry per IP address per day.

2. To enter, It's never too early to think of your prom outfit! Join our newest Instagram contest, Are you the NEXT #TCTOPMODEL, and get a chance to win a Sherri Hill dress. 3. For all official start and end dates for contests please contact Terry Costa. All entries must be received by the official end date to be deemed eligible. Terry Costa, Inc. is not responsible for lost, late, or misdirected entries, or for printer errors, server unavailability, computer or any other electronic malfunction.

4. One (1) prize winner will be randomly selected from among valid entries.

5. All entries received that are duplicate, mutilated, tampered with, incorrect, illegible, or from ineligible entrants will be void. All entries become the property of Terry Costa, Inc. and will not be acknowledged or returned.

The Prize

1. One (1) prize winner will receive one (1) gown of contest designer. Dress choice is subject to manufacturer availability.

2. Winner will be notified by email or phone. Before claiming prize, winner must provide their correct name, address and telephone number to Terry Costa, Inc. at the time of notification. Winner must sign and return a release and affidavit of eligibility, which must be received within 5 days of notification at the time winner claims his/her prize.

Terry Costa, Inc. reserves the right to examine additional identification and may choose to accept or deny awarding the prize based on the identification presented.

3. If the winner cannot be notified within 2 days (or shorter time period if the use of the prize is time sensitive, as announced by Terry Costa, Inc.), or does not timely sign and return the release and affidavit of eligibility, then the prize will be forfeited, and time permitting, the prize will be awarded to an alternate winner randomly selected from among remaining valid entries.

4. There will be no substitutions or cash alternatives for prize except at the sole discretion of Terry Costa, Inc. Terry Costa, Inc. has the right to substitute a prize of similar value. No transfer, sale, or assignment of prize is allowed.

5. Winner is responsible for paying shipping, all local, county, state and federal taxes on prize based on the estimated retail value of the prizes as set forth in these rules.

6. Only one prize will be awarded per household. Contestants are eligible to win only one prize within any 30 day period, regardless of the number of contests entered.

7. Terry Costa. Inc. and their affiliated companies are not liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize. Terry Costa, Inc, sponsors, and prize provider shall not be responsible for winner’s failure to claim the prize within the time frame described above.
